1. Acceptance of Terms

By accessing or using the website tenaxconstruction.com (“Site”) or engaging the services of Tenax Construction Inc. (“Company,” “we,” “us,” or “our”), you (“Client” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or services.

3. Contractor Licensing & California Law Compliance

Tenax Construction Inc. is a duly licensed contractor under the California Business and Professions Code (BPC) §7000 et seq., regulated by the Contractors State License Board (CSLB). We hold an active license and comply with all applicable state and local construction laws, including:

  • California Building Code (Title 24, CCR)

  • California Business and Professions Code §7000–7191

  • California Civil Code relating to mechanics’ liens and construction contracts

  • Local building codes for Sacramento, Placer, and El Dorado Counties

Warning required by California law: Under California law, a contractor is required to have a current and valid license issued by the Contractors State License Board (CSLB) before entering into any contract. Any contractor operating without a license may be subject to civil and criminal penalties.

4. Scope of Services

Tenax Construction Inc. provides the following services in the Sacramento metropolitan area and surrounding counties:

  • Kitchen Remodeling – Full design and construction of kitchen renovations

  • Bathroom Remodeling – Complete bathroom transformations

  • ICF Custom Home Construction – Insulated Concrete Form (Nudura) new home builds

  • Complete Home Remodels – Full interior and structural renovations

  • New Construction – Custom residential builds

All services are subject to a separate written contract signed by both parties prior to commencement of any work.

5. Written Contracts (Required by California Law)

In accordance with California Business and Professions Code §7159, all home improvement contracts with a value of $500 or more (including labor and materials combined) must be in writing. By law, your written contract must include:

  • A description of the work to be performed

  • The approximate start and completion dates

  • The contract price and payment schedule

  • Notice of the homeowner’s right to cancel within 3 business days (for contracts signed at the homeowner’s residence)

  • Notice of the Contractors State License Board’s complaint hotline: (800) 321-CSLB (2752)

  • Information on any mechanics’ lien rights

No verbal agreements shall be binding. Any changes to the scope of work must be documented via a written Change Order signed by both parties.

6. Estimates and Pricing

  • Free estimates provided through our Site or by phone are non-binding until formalized in a written contract.

  • All estimates are based on information available at the time of assessment. Prices may change due to unforeseen site conditions, material cost changes, or scope modifications.

  • Detailed line-item estimates are provided for full transparency. Tenax Construction Inc. does not charge hidden fees.

7. Payment Terms

Payment schedules are governed by the signed contract. However, pursuant to California Business and Professions Code §7159.5:

  • No contractor may accept a down payment exceeding 10% of the contract price or $1,000, whichever is less, on home improvement contracts for residential property of 4 units or fewer, unless the contractor has a valid CSLB Bond that covers such payments.

  • Progress payments are tied to completion of defined project milestones.

  • Final payment is due upon satisfactory project completion and client walkthrough.

Failure to make payments per the schedule may result in work stoppage and may trigger mechanics’ lien rights under California Civil Code §8000 et seq.

8. Mechanics’ Lien Notice

NOTICE TO OWNER: Under California law, those who furnish labor, services, equipment, or materials for construction of improvements to your property may have lien rights if they are not paid. A mechanics’ lien, if recorded, can result in your property being sold to pay for unpaid labor and materials, even if you have paid your contractor in full.

To protect yourself:

  • Pay with checks made jointly payable to the contractor and subcontractors/suppliers.

  • Require lien releases (unconditional) from all parties before making final payment.

  • Obtain a Preliminary Notice from all subcontractors and suppliers.

9. Permits and Code Compliance

Tenax Construction Inc. handles all required building permits and inspections as specified in the project contract. All work is performed in compliance with:

  • California Building Standards Code (Title 24)

  • Local municipal building codes (Sacramento, Placer, El Dorado Counties)

  • California Energy Code (Title 24, Part 6)

  • ADA requirements where applicable

The Client is responsible for providing accurate property information and granting lawful access to the worksite. Any delays caused by permit processing by local jurisdictions are beyond our control.

10. Warranty

Tenax Construction Inc. warrants all work performed against defects in workmanship in accordance with California law:

  • Express warranty terms are detailed in the signed contract and on our Warranty & Aftercare page.

  • Under California Civil Code §896–945.5 (Right to Repair Act), residential construction is subject to statutory construction defect standards.

  • Manufacturer warranties apply separately to materials and products installed.

Warranty claims must be submitted in writing to sales@tenaxconstruction.com.

11. Insurance

Tenax Construction Inc. maintains the following insurance coverage as required under California law:

  • General Liability Insurance

  • Workers’ Compensation Insurance (California Labor Code §3700)

  • Contractor’s License Bond as required by CSLB

Certificates of insurance are available upon request.

12. Financing Disclaimer

Tenax Construction Inc. facilitates access to third-party financing options including RenoFi, GoodLeap, and Acorn Finance. We are not a lender or financial institution. All financing agreements are between the Client and the respective lender. We encourage you to review all loan terms carefully before signing. Tenax Construction Inc. is not responsible for decisions made by third-party lenders.

13. Website Use & Intellectual Property

  • All content on tenaxconstruction.com, including text, images, logos, and project photography, is the property of Tenax Construction Inc. and protected by U.S. copyright law.

  • You may not reproduce, distribute, or use any content from the Site without prior written permission.

  • The Site is provided for informational purposes only. Tenax Construction Inc. makes no warranties regarding the accuracy or completeness of website content.

14. Limitation of Liability

To the fullest extent permitted by California law, Tenax Construction Inc. shall not be liable for:

  • Indirect, incidental, or consequential damages arising from use of the Site

  • Pre-existing conditions at the project site not disclosed by the Client

  • Delays caused by third parties, permit authorities, or force majeure events (including natural disasters, earthquakes, wildfires, or pandemics)

Our total liability for any claim related to construction services shall not exceed the total contract price paid by the Client for the specific project giving rise to the claim.

15. Dispute Resolution

In the event of a dispute arising from construction services, the parties agree to:

  1. Good-faith negotiation as the first step.

  2. Mediation through a mutually agreed mediator in Sacramento County, California.

  3. If mediation fails — binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Sacramento, CA.

These Terms are governed by the laws of the State of California. Venue for any legal proceedings shall be Sacramento County Superior Court.

Clients also have the right to file a complaint with the CSLB at (800) 321-CSLB (2752) or cslb.ca.gov.

16. Privacy Policy

Your use of our Site is also governed by our Privacy Policy, which is incorporated herein by reference.

17. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be posted on this page with an updated effective date. Continued use of our Site or services after changes are posted constitutes acceptance of the revised Terms.
